Circuit Clarifies Sentencing Reduction Standard for Weapon Possession

The standard for a sentencing reduction for weapon possession where the defendant claims he used the gun for "lawful sporting purposes" has been clarified by the Second Circuit, which said that lower courts should analyze "all relevant surrounding circumstances of possession -- including, but not limited to, actual use" in deciding where to grant a reduction.
