Judge OKs Claims Of Strict Liability Against Drugmaker
A Pennsylvania federal judge has ruled that a strict liability manufacturing-defect claim can be brought against Bristol-Myers Squibb over its anti-psychotic drug, Abilify. The judge read courts' silence on manufacturing-defect claims as leaving them open for plaintiffs to bring, as did another Pennsylvania federal judge in a separate case last year.
