Chris Dumler – the Scottsville lawyer and embattled Albemarle County board member – will not be removed from office under a recall petition, a judge has ruled.
Albemarle County Circuit Judge Cheryl Higgins found the evidence failed to show Dumler had neglected his office after his January conviction for misdemeanor sexual battery.
“[T]he court is limited to the grounds set forth in the statute,” Higgins said, according to The Daily Progress.
“The evidence clearly shows that the conviction has resulted in a loss of confidence by the public and by the Board of Supervisors, but the court does not find that … to be the equivalent of neglect of duty,” Higgins reportedly said as she dismissed the citizens’ petition for removal.
