The family of a man who was murdered by his father-in-law was awarded $9.6 million by a North Dakota jury on July 8, 2013. The plaintiffs were represented by Minneapolis attorneys Kathleen Flynn Peterson and Brandon Thompson.
Gene Kirkpatrick was convicted of the murder of Dr. Philip Gattuso following the death of Gattuso’s wife, Valerie, who was Kirkpatrick’s daughter, apparently to gain custody Gattuso’s daughter. Valerie Gattuso died in March 2009 following complications from surgery. Flynn Peterson also represented the Gattuso family in that medical malpractice lawsuit, which had settled confidentially.
The verdict included $4,406,139.50 for economic loss, $5 million for non-economic loss and the maximum $250,000 for exemplary damages.
“The terrible loss of Philip will be felt by his family and friends forever. We are grateful that the court understood that his life had meaning and applied this significant financial punishment against the responsible party,” said Roy Gattuso, Philip’s brother, in a press release.
